  Reflex Sympathetic Dystrophy (RSD)

Reflex Sympathetic Dystrophy (RSD), also known as Complex Regional Pain Syndrome, is a chronic neurological syndrome often caused by an injury to a nerve or soft tissue. Because the syndrome varies from person to person, it can be extremely difficult to diagnose and often goes overlooked. After an initial injury, the sympathetic nervous system begins to function abnormally for unknown reasons. Victims with RSD often present with symptoms of severe burning pain, changes in skin or bone density, sweating, swelling of limbs and extreme sensitivity to touch of any kind. Unfortunately, there is no single laboratory test to accurately diagnose RDS, so patients are forced to undergo multiple tests and physical assessments in order to obtain an accurate diagnosis.

What causes RSD?

Unfortunately, why RSD develops is not easily understood. What is known is that a variety of events often trigger the sympathetic nervous system to malfunction. A cut, sprain, fracture, nerve trauma, surgery, heart disease, strokes, carpal tunnel syndrome, cancer and some forms of medications can all trigger these painful symptoms and begin the lifelong struggle with RSD.

If diagnosed early, treatment for RSD is usually effective, but if left undiagnosed, RSD can lead to permanent disabilities, deformities and even death. Victims at every stage suffer from a decreased quality of life, decrease in job performance and severe pain requiring special pain management and therapies. Treatment usually includes a combination of therapies from anesthesiologists, psychologists, psychiatrists and rehabilitation nurses.

Many jobs require workers to make constant repetitive movement over large periods of time. These jobs and tasks can often lead to stress fractures, repetitive stress syndrome, carpal tunnel, and eventually, RSD. Because of its’ nature, victims of RSD are often denied Workman’s Compensation, making it even more difficult to obtain proper treatment. If you suffer from the symptoms of RSD and have been denied Workman’s Compensation or if you believe your RSD was the direct result of an automobile accident or medical malpractice, you may have the right to file a claim and seek compensation for your injuries.

RSD and the Law:

The first step towards filing a personal injury or social security claim is to locate an attorney specializing in RSD cases. Your attorney will need to accurately prove that your symptoms are directly related to the injury you sustained. Unfortunately, unlike many other injuries, proving RSD to a judge can be rather difficult. With RSD, the jury or judge often sees a plaintiff who appears healthy. There are no broken bones or bloody bandages to convince them of your pain and suffering. In addition, there are no real medical tests that can accurately confirm the diagnosis and as a result, judicial systems are not always sympathetic. A qualified personal injury attorney may need to present “before” and “after” witnesses who can lend real life testimony to the suffering you have endured as a result of RSD. In addition, a doctor who specializes in RSD may need to be called in to confirm your diagnosis and educate the court system on its debilitating results.

How your doctor diagnoses your symptoms is one of the most important pieces of the puzzle. Doctors are responsible for accurately diagnosing RSD and determining the level of disability likely to be associated with it. This estimate is important for obtaining high compensation for your injuries and also for obtaining Workman’s Compensation and Social Security Benefits. If you suffer from RSD, chances are you will be dealing with this debilitating disease throughout your life and you will need enough compensation to pay for medical bills, lost wages and pain medication as your disorder progresses. Your attorney will need to work together with your physician to ensure that all of your medical needs are met both now and in the future.

As expected, the defense lawyer will attempt to convince the judge and jury that your symptoms are fictional, subjective and motivated by ulterior motives. Companies, corporations and insurance companies will seek to deny responsibility for your pain and suffering and if you are inadequately prepared, you may find yourself without the necessary compensation you need to deal with this debilitating syndrome.

If you suffer from RSD, contact an experienced RSD personal injury attorney immediately. Your attorney will help you receive the medical care you need today and the financial compensation you need in the future to effectively battle RSD.
